How to Respond to a USCIS Request for Evidence (RFE) Without Losing Your Case

The 60-90 day deadline is fixed. What goes in the response, and how it's structured, is where cases are saved or lost. Here's the framework we use on every RFE.

You opened the mail and there it is — an RFE from USCIS. It's not a denial. It's not fatal. But the response you file will decide whether your case approves, denies, or turns into a NOID and eventual denial. Here's the framework.

What an RFE actually is

An RFE is USCIS telling you that the record as filed isn't sufficient to approve. Officers don't have discretion to approve on "trust us it's fine" — the regulatory or evidentiary standard has to be met on the record. When it isn't, they issue the RFE with a bulleted list of what they want to see and a deadline (usually 87 days, sometimes 33 or 60).

The critical first 48 hours

Every RFE contains three data points that dictate everything else. Extract them before you plan the response.

  1. The deadline. Missed deadlines convert automatically to denials. Calendar the response date the day the RFE arrives, not the deadline itself.
  2. The specific issues raised. Officers must be specific about what evidence is missing. Highlight every issue — don't respond to what you think they're asking, respond to what they actually asked.
  3. The requested evidence types. USCIS lists what will satisfy the RFE. Give them exactly that, not adjacent things you have handy.

Structure of a strong response

The response has three components. Skip any and you weaken the record.

1. Cover letter with a roadmap

Start with a 2-3 page letter that maps the officer's concerns to the evidence you're providing. Every issue raised in the RFE gets its own section, in the order the officer raised them. This gives the reviewing officer a checklist to work through — and it's often the same officer who issued the RFE, so making their job easy is your job.

2. Evidence organized by RFE issue

Tab or clearly label each evidentiary exhibit by RFE issue number. "Exhibit A responds to Issue 1 (specialty occupation); Exhibit B responds to Issue 2 (beneficiary qualifications)." Loose stacks of paper get discounted because officers can't tell what belongs where.

3. Argument for why the record now meets the standard

Don't just submit new documents — explain how they satisfy the regulatory standard USCIS cited. If USCIS said "the record does not establish that the position is a specialty occupation under 8 C.F.R. § 214.2(h)(4)(iii)(A)," your response should walk through the regulation and show how each element is now met.

Common mistakes we see

  • Sending everything you have. Officers get frustrated with 500-page dumps. Precise responses beat exhaustive ones.
  • Missing the deadline by a day. USCIS is unforgiving on this. If you need more time and haven't yet responded, contact us before the deadline — extensions are possible but require immediate action.
  • Responding to what you think USCIS meant, not what they wrote. Read the RFE line by line. Every issue gets an answer.
  • Failing to update supporting evidence. If USCIS asked for updated financials for an ability-to-pay issue, current tax returns beat prior-year ones.

When to file a supplemental record on your own

Occasionally strong evidence emerges after the initial filing but before an RFE issues. You can file a supplemental record on your own initiative — it's called a "supplementation" and USCIS accepts them as long as your case is still pending. This is rare but useful when timing catches up on you.
