Form I-129F: Petition for Alien Fiancé(e)

Form I-129F is how a U.S. citizen sponsors a foreign fiancé for a K-1 visa. K-1 visa holders must enter the U.S., marry the petitioner within 90 days, then file Form I-485 to adjust status. The I-129F can also cover K-2 dependents (fiancé's children under 21).

What Form I-129F Is

Form I-129F is the petition U.S. citizens file to bring a foreign fiancé to the United States on a K-1 nonimmigrant visa. Only U.S. citizens — not LPRs — can file. The petition must show the couple has met in person within the two years before filing, both are legally free to marry, and both intend to marry within 90 days of the fiancé's arrival.

The I-129F is followed by consular processing at the fiancé's home country embassy. On approval and entry, the couple must marry within 90 days; the fiancé then files Form I-485 to adjust to conditional permanent resident status.

Filing Fee

The USCIS filing fee for Form I-129F is $675 as of the April 2024 fee schedule. Additional State Department fees apply at the consular stage — the K-1 visa fee is currently $265.

Frequently Asked Questions About I-129F

No. Only U.S. citizens can petition a fiancé on Form I-129F. LPRs must marry the fiancé first, then file Form I-130 as a spouse — a longer wait since F2A visa numbers can be backlogged.
