EB-2 NIW Eligibility Requirements

You must first qualify for the underlying EB-2 category, then satisfy all three prongs of the Matter of Dhanasar national-interest test.

  1. EB-2 Base: Advanced Degree

    A U.S. master's degree or higher, or a bachelor's degree plus five years of progressive post-baccalaureate experience in the specialty.

  2. EB-2 Base: Exceptional Ability

    Alternatively, a degree of expertise significantly above the ordinary, shown by meeting at least three regulatory criteria such as degrees, experience letters, licenses, high salary, memberships, or recognition.

  3. Prong 1: Substantial Merit and National Importance

    The proposed endeavor must have both substantial merit and national importance — its potential impact reaches beyond a single employer or locality to a broader U.S. interest.

  4. Prong 2: Well Positioned to Advance the Endeavor

    You must be well positioned to advance the endeavor, evidenced by your education, skills, record of success, plan, and interest from relevant stakeholders or funders.

  5. Prong 3: Beneficial to Waive the Job-Offer Requirement

    On balance, it must benefit the United States to waive the job-offer and labor-certification requirements given your qualifications and the endeavor's value.
