Form I-907: Request for Premium Processing Service

Form I-907 requests premium processing on eligible petitions. USCIS guarantees a decision, Request for Evidence, Notice of Intent to Deny, or Notice of Intent to Revoke within a fixed processing window — usually 15 business days, with longer windows for EB-2 NIW (45 business days) and certain other categories.

What Form I-907 Is

Form I-907 is the premium-processing request filed with — or after — an underlying petition. It doesn't guarantee approval; it guarantees a substantive USCIS action (approval, denial, RFE, NOID, or NOIR) within a set window. If USCIS misses the window, the premium-processing fee is refunded and processing continues.

Not every form is eligible. Premium processing is currently available for I-140 (all categories, with a 45-day window for EB-2 NIW), most I-129 categories, and select I-539 and I-765 filings.

Forms Eligible for Premium Processing

  • I-140 — EB-1, EB-2 (including NIW at 45 days), EB-3
  • I-129 — H-1B, L-1, O-1, TN, E-3, and most other categories
  • I-539 — Change of status to F, J, M (limited categories)
  • I-765 — F-1 OPT and STEM OPT (rolling expansion)

Filing Fee

The USCIS premium processing fee is $2,805 as of the April 2024 fee schedule. This is separate from — and in addition to — the underlying form's filing fee.
